What happened
The Landlord applied to evict the Tenant using a Notice to End your Tenancy For Causing Serious Problems in the Rental Unit or Residential Complex (N7), alleging the Tenant seriously impaired safety by not maintaining the unit's sanitation and not participating in pest control. The LTB dismissed the application, finding the allegations did not meet the high threshold of 'serious impairment of safety' required for an N7 notice.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenant is dismissed. The Board found the Landlord's use of an N7 notice was improper, as the alleged issues of poor sanitation and non-cooperation with pest control did not constitute a 'serious impairment of safety' as legally required.
