What happened

Tenants applied for an order determining that the Landlord entered the rental unit illegally, substantially interfered with their reasonable enjoyment, and harassed them. The main issue was that the Landlord entered the unit while the Tenants were on vacation and had intimate relations with an unknown individual in one of the Tenants' bedrooms, which was caught on camera. The Tenants were so disgusted that they moved out upon their return.

The ruling

The Landlord must pay the Tenant $12,338, including $2,000 for replacement of disposed property, $2,250 for moving expenses, $7,000 in general damages, and a $3,000 fine to the LTB. The Landlord's actions of illegally entering the unit and engaging in intimate relations were found to violate the Tenant's rights.
