What happened
The Landlord applied to terminate the tenancy and evict the Tenant due to non-payment of rent. A preliminary issue arose regarding the validity of a 2023 rent increase, which the Tenant claimed never to have received. The Landlord provided evidence of consistent service practices via mailboxes and an online portal. The Board determined the rent increase was validly served, calculated the arrears accordingly, and granted the Tenant conditional relief from eviction based on a structured payment plan.
The ruling
The Tenant is ordered to pay $774.83 in arrears and costs through a monthly payment plan of $100 starting June 1, 2025, plus ongoing rent. If the Tenant misses any payment, the Landlord may apply for an immediate eviction order without further notice under Section 78 of the Act. Relief from eviction is granted conditional upon compliance with this schedule.
