What happened

The landlord applied for an order to determine whether the Residential Tenancies Act, 2006 applies to the tenancy. The landlord testified that he moved into the rental property on September 30, 2022 and signed a rental agreement with the tenants on October 5, 2022, and that the tenants were not living in the home prior to October 5, 2022. The landlord also testified that he shares a kitchen and/or bathroom with the tenants.

The ruling

The Residential Tenancies Act, 2006 does not apply to this tenancy as the landlord shares a kitchen and/or bathroom with the tenants, which is an exemption under section 5(i) of the Act.
