What happened

A motion was filed by the Tenants to set aside an eviction order which was issued after they breached a condition of a previous LTB order by failing to pay rent. At the hearing for the motion, one of the Tenants indicated they had found new accommodation and wished to vacate on June 30, 2025. The Landlord did not oppose this new move-out date. The Board denied the motion to set aside the eviction but ordered that the stay on the eviction order be lifted on July 1, 2025, effectively aligning with the Tenant's requested departure date.

The ruling

The Tenant's motion to set aside the eviction order (LTB-L-018144-25) is denied. The stay on that order is lifted effective July 1, 2025, allowing the tenancy to end on June 30, 2025, as requested by the Tenant at the hearing. The Landlord's request for costs is denied.
