What happened
Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's failure to meet certain conditions in a previous mediated settlement. The Tenant failed to pay the full $250 towards arrears and the full lawful rent of $794 by the due date of February 1, 2023.
The ruling
The tenancy is terminated effective May 6, 2023. The Tenant must pay the Landlord $10,128.50 (less any payments made after the application was filed) for rent arrears up to April 25, 2023, and the cost of the previous application. The Tenant must also pay the Landlord $26.10 per day for compensation for use of the unit starting April 26, 2023 until the Tenant moves out. If the Tenant does not pay the full amount by May 6, 2023, the Tenant will owe interest at 6% annually on the outstanding balance.
