What happened
The Landlord, RESCO Mortgage Investment Corporation, applied for an order requiring the Tenants, Kassandra Campbell and Joshua Claude Galland, to pay the rent they owed. The Landlord served the Tenants with a Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), but the Tenants did not void the notice by paying the rent arrears. The Landlord was seeking to collect the rent arrears, but the N4 Notice was found to be invalid, so the Board did not have the jurisdiction to terminate the tenancy.
The ruling
The Board ordered the Tenants to pay the Landlord $27,236, which includes $27,050 in rent arrears and $186 in application fees. If the Tenants do not pay the full amount by June 16, 2024, they will start owing interest at 7% annually on the outstanding balance.
