What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to pay rent as ordered in a previous LTB order. The landlord was entitled to apply under section 78 of the Residential Tenancies Act without notice to the tenant since the tenant did not meet the condition to pay rent by the due date.

The ruling

The tenancy is terminated effective May 14, 2023. The tenant must pay the landlord $10,839.45 plus $39.45 per day from May 4, 2023 until the tenant vacates the unit. If the tenant does not pay the full amount by May 14, 2023, the tenant will owe interest at 6% annually on the outstanding balance.
