What happened

The Landlord applied for termination of tenancy and eviction based on rent arrears. The Tenant, who is legally blind, raised several Section 82 issues, including maintenance concerns (cracked wall, faucet, floorboards, pests), withholding of heat, and human rights considerations. The Board dismissed most maintenance claims due to lack of evidence or improper reporting but found the Landlord failed to provide heat for a period in May and June 2025. The Board granted the eviction but provided relief by postponing the enforcement date to allow the Tenant time to receive pending disability benefits and potentially void the order.

The ruling

The tenancy is terminated effective November 30, 2025, unless the Tenant voids the order by paying arrears, fees, and ongoing rent. The Tenant is ordered to pay the Landlord $1,958.55 (representing arrears up to the hearing date and filing fees, minus the rent deposit, interest, and a $248.50 abatement for heat withholding). If the Tenant pays $5,725.50 by October 31, 2025, or $7,236.50 by November 30, 2025, the eviction is voided.
