What happened

The Tenants requested a review of an eviction order for non-payment of rent, claiming they never received the Notice of Hearing for the original August 12, 2025, proceeding. They alleged that the Landlord provided disclosure to an email address that was full. However, the Board found that the Notice of Hearing was mailed to the Tenants in June 2025 and was not returned. The Tenants were found to be evasive during cross-examination regarding their knowledge of rent arrears and had missed other hearing dates.

The ruling

The Tenants' request to review the eviction order (LTB-L-043954-25) is denied. The original order, which terminated the tenancy due to non-payment of rent, is confirmed and remains unchanged. The stay of the original order is lifted immediately.
