What happened
Tenants applied for an order determining the Landlord failed to meet maintenance obligations regarding persistent plumbing and equipment noise. The Tenants reported high-pitched squealing and rushing water sounds starting in late 2022. They also complained about contractor debris, specifically an Exacto-knife blade left in the shower, and the aesthetic quality of a ceiling repair. The Landlord maintained they responded to all complaints and conducted extensive investigations involving engineering and telecom specialists, but the intermittent nature of the noise made it difficult to diagnose.
The ruling
The Tenant's application for maintenance-related issues and rent abatement was dismissed. The Board found the Landlord met their maintenance obligations by responding reasonably and thoroughly to noise complaints, despite the significant time required to resolve the intermittent issues.
