What happened
The Tenant filed two applications (T6 and T2) alleging maintenance failures, illegal entries, harassment, and interference with reasonable enjoyment. Over a three-year period and multiple adjournments, the Board issued interim orders requiring the Tenant to provide specific particulars, including descriptions, dates, and requested remedies for each issue. Despite obtaining legal advice and receiving extensions, the Tenant failed to properly amend the application or provide the required details, instead submitting disorganized documents and photos. The Landlords requested dismissal due to the lack of clarity and the Tenant's failure to follow procedural directions.
The ruling
The Landlord and Tenant Board dismissed the Tenant's applications (T2 and T6) because the Tenant repeatedly failed to comply with Board orders to provide specific details and dates regarding his claims. The Board concluded that it would be unfair to grant a third opportunity to amend the application, as the Landlords could not adequately defend themselves against the disorganized and vague allegations provided by the Tenant.
