What happened
The Landlord applied to terminate the tenancy and evict the Tenant based on an N7 notice. The Landlord alleged that the Tenant caused a flood in her unit, failed to report it, and broke into the basement to shut off the water, thereby seriously impairing the safety of persons in the residential complex.
The ruling
The Landlord's application to terminate the tenancy and evict the Tenant is dismissed. The Board determined that the allegations in the N7 notice regarding a flood and a broken basement lock did not constitute a 'serious impairment of safety' under section 66 of the Residential Tenancies Act.
