What happened
Landlords applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The Tenants had various maintenance claims and other allegations which they felt entitled them to a rent abatement, but they did not properly disclose these issues prior to the hearing. The parties agreed that the Tenants vacated the rental unit on July 15, 2022 and the rent arrears owing are $17,656.90.
The ruling
The tenancy was terminated effective July 15, 2022, the date the Tenants vacated the rental unit. The Tenants are ordered to pay $15,341.17 to the Landlords, which includes rent arrears up to the move-out date and the cost of filing the application, minus the rent deposit and interest on the deposit.
