What happened
The Landlord filed an application for personal use (N12), stating his son needed the unit for post-secondary studies. Due to a nearly two-year delay before the hearing, the son had completed his studies, making the eviction reason moot. At the hearing, the Landlord requested to withdraw the application but asked for the one-month rent compensation, previously paid to the Tenants, to be returned. The Tenants objected. The Board denied the withdrawal, dismissed the application, and ordered the Tenants to repay the compensation to the Landlord.
