What happened
The Tenants filed a motion to set aside an eviction order that was issued without a hearing after they breached a previous consent order regarding rent arrears. The Tenants admitted to the breach but alleged the Landlord attempted an unlawful eviction by telling them to leave because the house was being sold. The Landlord disputed this, stating he was facing foreclosure due to the Tenants' failure to pay rent and merely informed them of a 'for sale' sign. The LTB member found the Tenants had failed to meet their payment obligations regardless of the Landlord's intent to sell.
The ruling
The Tenants' motion to set aside the eviction order is denied. The stay of the previous order is lifted effective September 26, 2025, allowing the Landlord to proceed with eviction due to significant rent arrears exceeding $11,000.00 and the Landlord's risk of losing the property to foreclosure.
