What happened
The Landlords applied to terminate the tenancy and evict the Tenants due to non-payment of rent, persistent late payments, and failure to pay utilities. The Tenants acknowledged the arrears but requested relief from eviction, citing temporary financial hardship due to medical and family circumstances. The Member found that the Tenants' income was returning to normal and granted relief from eviction subject to a strict payment schedule for the arrears and utilities.
The ruling
The LTB granted the Tenants relief from eviction on the condition that they adhere to a specific payment schedule to repay $14,697.82 in rent arrears, utilities, and filing costs. Payments are scheduled between November 2025 and May 2026. If the Tenants miss any payment, the Landlord may apply for an immediate eviction order without further notice to the Tenants.
