What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent and the landlord's need for personal use of the rental unit. The landlord served a valid N12 notice for personal use and the tenants did not void the N4 notice for non-payment of rent.
The ruling
The tenancy is terminated effective May 1, 2023. The tenants must vacate the rental unit by that date. If they do not, the landlord can file the order with the Sheriff to enforce the eviction. The tenants must pay the landlord $28,928.30, which includes rent arrears and the application filing fee, minus the rent deposit and interest. The tenants must also pay daily compensation of $92.05 from March 10, 2023 until they move out.
