What happened
The Landlords applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Landlords served a valid N4 notice. During the hearing, it was discovered that the initial oral calculation of arrears did not include rent due on June 15, 2025. The Tenant requested a delay in eviction to find new housing and support her three children, one of whom has medical conditions (ADHD and Bipolar).
The ruling
The tenancy is terminated effective October 3, 2025, unless the Tenant voids the order by paying the full amount of arrears and filing fees. If the Tenant does not void the order, she must vacate by October 3, 2025, and pay the Landlord $8,323.33 plus daily compensation of $93.70 for each day she remains in the unit after August 27, 2025.
