What happened
Landlord applied for an order to terminate the tenancy and evict Tenants due to failure to pay rent. The application was filed after serving a valid Notice to End Tenancy Early for Non-payment of Rent (N4 Notice), which the tenants did not void by paying the arrears. One of the tenants had vacated the rental unit, but the landlord did not enter into a new lease agreement with the remaining tenants.
The ruling
The tenancy was terminated effective May 7, 2023 unless the tenants pay $14,180.06 by April 30, 2023 or $15,859.40 by May 7, 2023 to void the order. If the tenants do not pay, they must move out by May 7, 2023 and pay the landlord $9,881.39, plus daily compensation of $55.21 from March 15, 2023 until they move out.
