What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to non-payment of rent. The Tenant was not the original tenant named in the tenancy agreement, but had an oral agreement with the Landlord to pay $1,000 per month starting January 2023. The Landlord served the Tenant with a valid N4 notice, but the Tenant did not void the notice by paying the rent arrears.

The ruling

The tenancy is terminated unless the Tenant pays $7,186 to void the order by July 15, 2023. If the Tenant does not pay, the tenancy is terminated, and the Tenant must pay $5,876.48 to the Landlord plus daily compensation of $32.88 per day starting June 22, 2023 until the Tenant vacates the unit.
