What happened

The Landlords filed an application to evict the Tenants for non-payment of rent. At the hearing, the Tenants attempted to raise issues under section 82 of the RTA but were not permitted due to failing to provide the required written disclosure to the Landlords and the Board. The Tenants, who experienced job loss, proposed a repayment plan, but the Board denied their request for relief from eviction, citing the significant amount of arrears (over $10,000) and their payment history.

The ruling

The tenancy is terminated unless the Tenants pay $12,286.00 by May 12, 2025. If payment is not made, the Tenants must vacate by May 12, 2025, and are ordered to pay the Landlords $8,232.10 for arrears and costs, less the rent deposit. Additionally, they must pay daily compensation of $59.18 from April 25, 2025, until they move out. The Tenants' request for relief from eviction was denied due to the substantial arrears and poor payment history.
