What happened
The Landlords applied to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants raised issues regarding water pressure under Section 82, but these were dismissed because the Tenants failed to provide evidence to the Landlords before the hearing and the Member determined the issue did not constitute a 'serious breach' of maintenance responsibilities. The Landlords cited financial hardship regarding mortgage payments, noting the Tenants had not paid rent since the start of the tenancy in March, aside from the initial deposit.
The ruling
The tenancy is terminated effective August 29, 2025. The Tenants are ordered to pay $10,993.81 to the Landlords for rent arrears and the filing fee, after deducting the rent deposit and interest. To void the eviction and continue the tenancy, the Tenants must pay $17,686.00 by August 29, 2025. Daily compensation of $115.07 is required for each day the Tenants remain past August 11, 2025.
