What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant because the Landlord in good faith requires possession of the rental unit for the purpose of residential occupation for at least one year. The Tenant requested a review of the order and that the order be stayed until the request to review the order is resolved.

The ruling

The request to review order LTB-L-047883-22 issued on November 15, 2022 is granted. The Landlord's L2 application is dismissed. The Tenant shall return the compensation cheques to the Landlord or pay the compensation amount of $837 by January 14, 2023, after which interest will start accruing.
