What happened
The landlord applied for an order to terminate the tenancy and evict the tenants and for an order to have the tenants pay the rent they owe because the tenants did not meet a condition specified in the mediated settlement signed by the parties on July 27, 2022 with respect to application LTB-L-003676-22. The tenants filed a motion to set aside the order issued on January 9, 2023.
The ruling
The motion to set aside Order LTB-L-070352-22, issued on January 9, 2023, is denied. The stay of order LTB-L-070352-22 is lifted immediately. The tenants shall pay the landlord $366.60 for the enforcement fee the landlord incurred by June 9, 2023. If the tenants do not pay the full amount by the due date, they will start to owe interest at 6.00% annually on the outstanding balance.
