What happened

Landlord applied for an order to terminate the tenancy and evict the Tenant due to the Tenant's alleged conduct that substantially interfered with the Landlord's reasonable enjoyment or lawful right, privilege or interest. The Landlord claimed the Tenant stored items in the hallway, refused the Landlord entry to the rental unit, and changed the locks to the rental unit door without providing the Landlord with a replacement key.

The Landlord's application is dismissed as the Landlord has failed to establish on a balance of probabilities that the Tenant's conduct is in breach of section 64(1) of the Residential Tenancies Act, 2006.
