What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenants due to persistent non-payment of rent. Despite the Landlord's attempts to negotiate a repayment plan, the Tenants did not respond and failed to attend the hearing. While the Tenants made a significant payment toward the arrears after the application was filed, a balance remained outstanding as of the hearing date.
The ruling
The LTB ordered the termination of the tenancy effective July 22, 2025, unless the Tenants pay $2,052.32 (the full amount including future July rent) to void the eviction. If the Tenants do not pay and the tenancy is terminated, they are ordered to pay the Landlord $174.53, representing the arrears up to the hearing date plus the filing fee, after applying the rent deposit and interest. Daily compensation of $35.83 is also required for each day the Tenants remain in the unit after July 9, 2025.
