What happened
The Landlord applied for eviction and rent arrears after the Tenants failed to pay rent. Tenant 1, a full-time student, argued that she was waiting for OSAP funding to cover the arrears. While the Landlord noted financial strain, they did not object to a delayed eviction to allow the Tenant time to secure funds. The Board found the N4 notice valid despite a minor unit description issue and ordered the tenancy terminated unless the Tenants paid the arrears to void the order.
The ruling
The LTB ordered the termination of the tenancy effective December 31, 2025. The Tenants can void the eviction by paying $12,986.00 by November 30, 2025, or $16,186.00 by December 31, 2025. If the Tenants do not void the order and move out, they are ordered to pay $8,658.86 plus daily compensation of $105.21 until they vacate.
