What happened

Landlord applied for an order to terminate the tenancy and evict Tenants due to non-payment of rent and the Landlord's good faith requirement of the rental unit for personal use. The Landlord served a valid N4 Notice, but the Tenants did not void the notice by paying the arrears. The Tenants were not present at the hearing.

The ruling

The tenancy is terminated unless the Tenants pay $39,666 by July 31, 2024 or $42,956 by August 11, 2024 to void the order. If the Tenants do not void the order, they must pay $34,184.27 to the Landlord and vacate the unit by August 11, 2024. The Landlord's L2 application for personal use is adjourned to a date after February 12, 2025.
