What happened
The Applicant applied for an order alleging the Landlord changed the locks without providing keys, substantially interfered with their reasonable enjoyment of the unit, and harassed them. The Landlord challenged the Board's jurisdiction, arguing the Applicant was an occupant and not a tenant under the Act.
The ruling
The application is dismissed. The Board found that Renu Sharma was an occupant rather than a tenant, as the lease agreement named a different person as the tenant and explicitly listed Sharma as an occupant. As there was no tenancy agreement between the parties, the Landlord and Tenant Board does not have the jurisdiction to hear the application regarding lock changes, interference, or harassment.
