What happened

The Landlord obtained an ex-parte eviction order after the Tenant breached a previous payment plan ordered by the LTB. The Tenant filed a motion to set aside that eviction order, citing family medical issues and a death in the family as reasons for the missed payments. However, the Tenant also admitted to intentionally withholding rent funds to save for a potential move after the Landlord filed the application. The Landlord, facing his own family health crisis and financial hardship, requested the eviction stand so he could sell the property.

The ruling

The Tenant's motion to set aside the eviction order is denied. The stay of enforcement is lifted effective October 15, 2025, to allow the Tenant a short period to find alternate accommodations. The original eviction and payment order (LTB-L-066655-25) remains unchanged.
