What happened
The Landlord applied for an order requiring the Tenants to pay out-of-pocket expenses for unpaid utility costs (heat, electricity, and water) as per the tenancy agreement. The Tenants had already vacated the rental unit on July 17, 2025. A previous consent order had established that the Tenants were responsible for these utilities. The Landlord sought to amend the claim to include updated invoices. The Landlord was also holding a rent deposit and interest which needed to be accounted for in the final balance.
The ruling
The Landlord's application for utility costs was successful in identifying a debt of $727.56 plus the $186.00 filing fee. However, because the Landlord was holding a rent deposit of $3,800.00 plus $226.18 in interest, the Landlord was ordered to pay the remaining balance of $3,222.32 to the Tenants by November 29, 2025.
