What happened
The Landlord applied to terminate the tenancy and evict the Tenants due to significant rent arrears. The Tenants did not attend the hearing personally, but Tenant 1's mother represented her, presenting a letter citing health issues and sudden expenses as the reason for arrears. The Tenants proposed a payment plan, which the Landlord opposed, citing previously broken promises and additional unpaid utility bills. The Member found the arrears substantial and determined that a payment plan was not viable, particularly as the Tenants were not available for cross-examination regarding their financial means.
The ruling
The tenancy is terminated effective September 28, 2025. To void the eviction and continue the tenancy, the Tenants must pay $17,186.00 by September 19, 2025, or $19,986.00 by September 28, 2025. If the Tenants do not void the order, they must vacate by September 28, 2025, and pay the Landlord $11,554.93, plus $92.05 daily compensation from August 21, 2025, until they vacate. The Landlord may file for eviction with the Sheriff starting September 29, 2025.
