What happened

The Tenant applied for an order determining that the Landlord gave a notice of termination in bad faith. The Landlord served an N12 notice claiming his son would move into the unit. However, the Tenant provided evidence that the property was listed for sale and sold shortly after she vacated. The Landlord failed to attend the hearing to rebut the presumption of bad faith.

The ruling

The Landlord is ordered to pay the Tenant a total of $6,648.00 by November 2, 2025. This includes $6,600.00 in general compensation for a bad faith N12 eviction and the $48.00 application filing fee. If payment is not made on time, 4.00% annual interest will accrue.
