What happened

The Landlord applied for compensation for damages after the Tenants vacated the unit. The Landlord alleged that the Tenants caused undue damage to the master bedroom carpet using an office desk and chair, resulting in a rip and a stain. The Tenants argued that the wear was normal use after a five-year tenancy and that they had already paid $500 as a goodwill gesture.

The ruling

The Landlord's application for carpet repair costs and filing fees was dismissed. The LTB found that the carpet damage was consistent with normal wear and tear after a five-year tenancy and did not constitute 'undue damage'. The Tenants are not required to pay any further amounts to the Landlord.
