What happened

The Landlord sought to terminate the tenancy based on persistent late payment of rent and personal use for residential occupation. An initial order for eviction was issued on March 6, 2025, after the Tenants failed to attend the hearing. Tenant 2 requested a review of that order, claiming she was unable to participate due to illness and non-receipt of the notice of hearing. The Member reviewed whether the Tenants were reasonably unable to participate or if the original order contained a serious error.

The ruling

The request to review the eviction order is denied. The original order dated March 6, 2025, is confirmed. The stay of the eviction is lifted effective July 31, 2025, allowing the Tenants additional time to move since they have occupied the unit for eight years and have a new unit ready on August 1, 2025.
