What happened
The Landlords applied to terminate the tenancy after the Tenant breached a mediated settlement agreement. This led to an ex parte eviction order. The Tenant moved to set aside that order, but the motion was denied on June 6, 2025. The Tenant subsequently requested a review of that denial, arguing procedural unfairness and raising issues about the Landlord's intent to sell the property. The LTB found no serious error in the previous proceeding and noted that the Tenant failed to dispute the evidence of over $18,000 in rent arrears.
The ruling
The Tenant's request for review of the motion order issued on June 6, 2025, is denied. The previous order, which denied the Tenant's motion to set aside an ex parte eviction order, remains in full force. The Tenant continues to owe rent arrears exceeding $18,000.00.
