What happened
The Landlord applied for an order to terminate the tenancy and evict the Tenant due to persistent late rent payments. By the time of the hearing, the Tenant had already vacated the rental unit. The primary dispute during the hearing centered on whether the Tenant should be responsible for the Landlord's $186.00 application filing fee. The Tenant argued she never received the N8 termination notice and would have moved earlier to avoid the application if she had. The Landlord provided evidence of service by mail. The Board determined the notice was properly served and ordered the Tenant to reimburse the filing fee.
The ruling
The LTB ordered that the tenancy was terminated effective September 30, 2025, the date the Tenant moved out. The Tenant is ordered to pay the Landlord $186.00 to cover the application filing fee. If payment is not made by November 18, 2025, interest will accrue at a rate of 4.00% annually.
