What happened

A Tenant requested a review of an eviction order that was issued after a hearing she did not attend. The Tenant claimed her legal representative, a law student, failed to inform her she needed to attend and was negligent in submitting evidence late. The Member found the Tenant was not diligent, as the Notice of Hearing clearly stated the risks of non-attendance, and email evidence showed the Tenant, not her representative, was late in providing documents. The review was denied, and the original eviction order was upheld.

The ruling

The Tenant's request to review the eviction order LTB-L-086212-24 is denied. The original order is confirmed and remains unchanged. The interim stay on the eviction is lifted effective June 20, 2025, allowing the Landlord to proceed with the eviction. The Member noted the Tenant may still have an opportunity to file a separate motion to void the eviction order if the arrears have been paid.
