What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to non-payment of rent. The Tenants attempted to raise maintenance and other issues under Section 82 of the Act during the hearing but were barred from doing so because they failed to provide required disclosure to the Landlord within the mandatory 7-day timeframe. The Tenants acknowledged the arrears and requested a long-term payment plan to avoid eviction and potential homelessness.

The ruling

The LTB ordered the Tenants to pay a total of $5,432.86. Eviction was stayed provided the Tenants adhere to a payment plan: $360.00 by October 23, 2025, followed by monthly payments of $360.00 toward arrears plus full monthly rent until January 2027. If any payment is missed, the Landlord may apply for an ex parte eviction order.
