What happened

The landlord applied for an order to terminate the tenancy and evict the tenant due to the tenant's failure to meet a condition specified in a previous LTB order. The condition was that the tenant would not smoke inside the rental unit and not engage in activities that would create a noise disturbance for a period of one year.

The ruling

The previous LTB order is cancelled. The tenancy between the landlord and the tenant is terminated, and the tenant must move out of the rental unit on or before May 28, 2023. If the unit is not vacated by that date, the landlord may file the order with the Court Enforcement Office (Sheriff) to have the eviction enforced.
