What happened
The Landlord filed an application for non-payment of rent. At the hearing, one Tenant requested to remove her sister from the joint tenancy, claiming she had moved out and the Landlord had agreed. The Landlord denied this claim, and since the Tenant provided no proof, the request was denied. The Tenants had already vacated the rental unit on October 31, 2024. The Tenant's attempt to raise issues under section 82 of the Act was dismissed because they failed to properly serve evidence on the Landlord.
The ruling
The tenancy is terminated as of October 31, 2024, the date the Tenants moved out. The Tenants are ordered to pay the Landlord $5,710.85 for rent arrears and the application fee, minus the rent deposit and accrued interest. Payment is due by June 1, 2025, after which interest at 5.00% annually will apply to the outstanding balance.
