What happened
The Landlord applied for an order to terminate the tenancy for personal use (N12), stating he required the basement unit for privacy. The Landlord served the notice and filed the application while the property was still under a purchase agreement, prior to the actual closing date. The Tenants did not attend the hearing.
The ruling
The Landlord's application to terminate the tenancy for personal use was dismissed. The adjudicator ruled that the Landlord lacked the legal standing to serve a notice of termination or file an application before the closing of the real estate transaction through which he acquired the property. Additionally, the required affidavit was found to be technically deficient.
