What happened

Landlord applied for an order to terminate the tenancy and evict Tenant due to non-payment of rent and persistent late payment of rent. The Landlord served valid N4 and N8 notices, but the Tenant did not void the notices by paying the arrears. The Tenant was not present at the hearing, but later advised that he was sleeping due to working nights.

The ruling

The tenancy is terminated unless the Tenant pays $5,611.09 by February 29, 2024 or $7,261.09 by March 19, 2024 to void the order. If the Tenant does not pay, they must vacate the unit by March 19, 2024 and pay the Landlord $55.84 plus daily compensation of $54.25 from December 22, 2023 until move-out.
