What happened
Tenant applied for an order determining that Landlord collected or retained money illegally. During the hearing, it was established that the individual named as the Landlord was actually a tenant himself who was renting out individual rooms within the unit where he also resided. As a result, the respondent did not meet the legal definition of a landlord under the Residential Tenancies Act, 2006.
The ruling
The Tenant's application was dismissed for lack of jurisdiction. The Board found that the Respondent was a tenant renting out rooms while living in the same unit, which excludes them from the legal definition of a 'landlord' under the Residential Tenancies Act, 2006.
