What happened

Landlords applied to terminate the tenancy and evict the Tenants due to non-payment of rent and the Landlords' good faith requirement of the rental unit for their own residential occupation. The ruling

The Landlords served valid N4 and N12 notices. The Tenants did not void the N4 notice by paying rent arrears. The Landlords have a genuine intent to occupy the unit for their own residential use for at least 1 year. However, considering the Tenants' long-term tenancy, one Tenant's health issues, and the daughter's challenges, the Board is granting a postponement of eviction until November 30, 2024 to allow the Tenants more time to find a new place to live.
