What happened

The Landlord applied to terminate the tenancy because they required the unit for a caregiver to provide services to the Landlord's spouse's parent. A previous order had been issued, which the Tenant requested to be reviewed. The Board found that the statutory requirements for a caregiver eviction were not met because the person receiving the care did not reside in the same building as the rental unit.

The ruling

The Landlord's application to evict the Tenant for personal use (caregiver) is dismissed. The Board ruled that since the person receiving care services (the Landlord's father-in-law) does not live in the same building as the rental unit, the statutory requirements of the Residential Tenancies Act were not met. The Tenant is ordered to return the $900.00 compensation cheque to the Landlord by July 29, 2025.
