What happened

The Landlord applied for an order to terminate the tenancy based on a breach of a mediated settlement order (LTB-L-000204-25). An ex-parte eviction order was initially granted. The Tenants filed a motion to set aside this order, arguing that no breach occurred or that eviction would be unfair. The Landlord alleged several breaches, including a kitchen fire, physical altercations in common areas, and refusal to allow pest control.

The ruling

The Tenants' motion to set aside the eviction order is denied. The adjudicator confirmed that the Tenants breached the previous order by causing fire damage and engaging in physical violence on the premises. Although the stay of the eviction is lifted, the adjudicator delayed the enforcement until August 31, 2025, to allow the Tenants, who are on ODSP, time to find new housing.
