What happened

The Landlord applied to terminate the tenancy and evict the Tenants due to persistent late payment of rent. Evidence showed the Tenants were late paying rent 7 out of 8 months between October 2024 and May 2025. While the grounds for termination were met, the Tenants requested relief from eviction, citing a change in financial circumstances and a commitment to pay on time in the future.

The ruling

The tenancy is allowed to continue provided the Tenants adhere to strict 'pay on time' conditions. The Tenants must pay the October 2025 rent by October 24, 2025, and thereafter pay all rent in full and on time on the first of each month until October 1, 2026. If a breach occurs, the Landlord may apply for an eviction order without further notice to the Tenants.
