What happened

The Landlord applied to terminate the tenancy and evict the Tenant due to rent arrears. Despite being served with an N4 notice, the Tenant did not pay the full arrears before the application was filed. Evidence at the hearing showed the Tenant had made significant payments recently to keep the arrears low, but failed to attend the hearing or respond to the Landlord's attempts to establish a payment plan.

The ruling

The LTB ordered the tenancy terminated effective July 31, 2025. However, the Tenant can void this order and continue the tenancy by paying $1,244.60 by July 31, 2025. If the tenancy is terminated, the calculation shows the Landlord actually owes the Tenant $826.09 after applying the rent deposit and interest against the arrears and filing fee (subject to adjustments for daily compensation if the Tenant remains past July 4, 2025).
